Minimum Participation Not Met
If we do not meet the minimum number of participants, the tour will be canceled. You may reschedule or receive a full refund of your deposit.Adverse Weather or Port Closure
All tours are subject to weather and sea conditions. If the port is closed by authorities due to weather, or if conditions are deemed unsafe by our team, we will cancel the tour and either reschedule or refund the full deposit. Safety is always our top priority.

Cancellations must be made via email, phone, or WhatsApp.
Cancellations made less than 72 hours before departure will not be refunded, and the full cost of the tour will be charged.
No-shows or late arrivals (over 15 minutes past departure time) will be considered cancellations, and no refunds will be issued.
We strongly recommend arriving before your scheduled time to avoid any delays or complications.

More than 120 days before departure: Refund minus any service incurred (non-refundable and non-transferable).
91–120 days before departure: 50% cancellation fee applies.
Less than 90 days before departure: No refund will be issued.
If we can fill your canceled spot, your deposit can be applied to another expedition within the next 12 months. This credit is non-transferable and can only be used once.
All cancellations must be submitted in writing via email and acknowledged by a staff member.
We highly recommend purchasing travel insurance to cover non-refundable expenses, including air travel and last-minute cancellations.

We do our absolute best to run all trips as scheduled. However, we reserve the right to cancel any activity or expedition at any time, for any reason, including but not limited to safety, operational, or environmental concerns.
Cancellations Initiated by Us
Cancellations within our control:
If we must cancel a trip for reasons within our control (e.g., staffing issues, equipment failure, or logistical problems), you will receive a full refund of all payments made directly to us.Cancellations due to force majeure:
If a trip is canceled due to reasons beyond our control — such as weather, natural disasters, political instability, port closures, or other acts of nature — we will:Work with you to reschedule the trip when possible
Allow you to apply your deposit to a future expedition within 12 months
Assist you in recovering costs, if feasible, but we cannot guarantee refunds
No compensation will be provided for associated costs like airfare, accommodation, or lost vacation time
This is why comprehensive travel insurance is strongly recommended
Weather and Sea Conditions
Ocean activities are inherently subject to sea and weather conditions. We prioritize your safety above all else. The following policies apply when sea conditions are a factor:
One-Day Tours
If we determine that weather conditions make it unsafe to go to sea:
We will attempt to reschedule your activity within your travel window
If rescheduling is not possible, you may apply your deposit to a future activity or request a full refund
Please note: If you choose not to participate due to conditions but we deem it safe to operate, no refund will be given
Extended Expeditions
In the case of weather-related cancellations during multi-day trips:
We cannot offer partial refunds for missed ocean outings, as trip costs are pre-paid and non-refundable
We will always make every effort to arrange alternative activities when ocean conditions prevent us from going out to sea

All participants must sign a liability release waiver prior to the activity.
Participants should:
Be in good physical condition
Be comfortable in the water
Ideally have some prior experience in ocean-based activities
Guests under 12 years old must be accompanied by a parent or legal guardian, who must sign the waiver on their behalf.
Full payment for the activity is required before departure.

All packages are subject to availability.
Due to potential delays in updating online availability, we strongly recommend contacting us directly before booking online.
Once we confirm availability, we will hold the package for 24 hours, during which you can finalize your booking through our BOOK ONLINE page.

Refunds may be issued under the following conditions:
Guest cancellations more than 72 hours before departure are eligible for a full refund.
No refunds will be given:
If no sharks or wildlife are seen — these are wild animals in their natural habitat, and sightings are not guaranteed.
In cases of seasickness — ocean conditions vary, and we recommend taking preventive medication if needed.
If the activity is interrupted or ended early due to weather or safety concerns — our team may halt a tour at any time for the safety of all.

Your safety is our top priority. Participants must inform us in advance of any medical conditions, allergies, or dietary restrictions. Our guides reserve the right to deny participation if they determine a risk to health or safety exists.

Sea and weather conditions can change rapidly. While we monitor forecasts and act accordingly, we cannot guarantee specific weather. We may adjust or cancel any activity in the interest of safety, without notice. Refunds in these cases follow the policies stated above.

We expect respectful behavior from all guests toward staff, wildlife, and other participants. The following may result in removal from the activity without refund:
Disrespectful or aggressive behavior
Failure to follow guide instructions
Alcohol or drug use before or during tours
Any action that endangers oneself, others, or marine life

We may capture photo or video content during tours for marketing purposes.
By participating in our tours, you grant us the right to use any images or video in which you may appear for promotional purposes, unless explicitly stated otherwise in writing before the activity.
All media provided by Uncharted Expeditions (photos, videos, promotional material) remains our intellectual property.
No third party, including partner operators, may use our content without explicit, written permission.
No exclusivity is granted over any of our media.

We may collect personal information solely to ensure the best service possible. This may include:
Full name
Date of birth
Email address
Phone number
Dietary restrictions / allergies
Your information is never sold or shared with third parties without your consent and is stored securely according to our privacy practices.

All content produced, shared, or distributed by Uncharted Expeditions, including but not limited to photographs, videos, text, logos, graphics, and branding elements, is the exclusive property of Uncharted Expeditions, or of the lawful owners (e.g., photographers or videographers) from whom we have obtained permission to use such content.
Any media provided to guests, partners, or made public through our website, social media, or promotional materials — whether created by us or licensed to us — remains the intellectual property of Uncharted Expeditions, regardless of who receives or shares it. Content created or curated by others on our behalf is, by definition and use agreement, also protected under our ownership rights.
No individual, partner, or third party is permitted to:
Copy, reproduce, republish, redistribute, edit, sell, or exploit any content in whole or in part
Use our content for commercial, promotional, or editorial purposes without express prior written permission
This includes any photos or videos given to clients as part of any included package. Such content is provided for personal use only, and does not grant ownership or licensing rights of any kind.
We reserve the right to request the deletion, return, or removal of any media shared with clients or third parties at any time, should we determine — at our sole discretion — that the media is being misused, misrepresented, or displayed inappropriately on any platform (including social media, websites, print, or other formats).
Unauthorized use of our content or failure to comply with a removal request may result in legal action.

We highly recommend that all participants carry valid travel and medical insurance that covers accidents, injuries, medical emergencies, and trip cancellations or interruptions — regardless of whether you're joining a single-day tour or a multi-day expedition.
While we take every precaution to ensure your safety and comfort, unforeseen circumstances such as illness, injury, delays, or lost belongings can occur — especially in remote marine environments. Having adequate insurance allows us to assist you more effectively in the event of an emergency.
If your insurance is provided through a credit card or third party, we recommend verifying the extent of your coverage and carrying a copy of the policy while traveling with us.
Please note that we are not liable for any costs incurred due to accidents, medical issues, travel disruptions, or property loss or damage during your participation in any of our activities.

We may provide high-quality equipment for the duration of your activity, including but not limited to masks, snorkels, wetsuits, weight belts, fins, and dive gear. By participating in our tours, you agree to use the equipment responsibly and return it in the condition it was provided.
In the event that any gear is lost or damaged due to negligence or misuse, we reserve the right to charge the participant for:
The full retail value of the item
Applicable shipping and replacement fees
A 20% handling fee to cover the time and logistical costs involved
Please note: We operate in a remote location, and replacement of gear can be challenging and expensive. We kindly ask all participants to treat equipment with care and respect to avoid additional charges.

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website and take effect immediately. Continued use of our services after updates constitutes acceptance of the new terms.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Baja California Sur, Mexico, without regard to its conflict of law principles.
